Former SEC Chairman Jay Clayton was criticized by Ripple CEO Brad Garlinghouse after he stated that the SEC should initiate legal proceedings against certain companies under conditions where the SEC had strong legal grounds. The SEC began to take action against cryptocurrency companies since the first quarter of 2023. In an interview with CNBC on June 29, 2023, Clayton emphasized that the SEC should initiate legal proceedings against specific companies, provided that they have a strong legal basis.
In response to a tweet from Cameron Winklevoss, sharing Clayton's interview from June, Brad Garlinghouse claimed that the former SEC chairman had adopted a different attitude. Garlinghouse reminded that Jay Clayton left the building [SEC] after filing a lawsuit against Ripple, Chris Larsen, and me.

Clayton's statements gained attention again following the recent developments in the Ripple lawsuit. In October, the SEC requested the dismissal of charges against Ripple executives. This move came after Judge Analisa Torres ruled in favor of Ripple in July, stating that the sale of XRP on cryptocurrency exchanges did not constitute a securities sale.
